Changes in Criminal Defense Law - What It Means to You

There are new defense laws in Texas governing criminal behavior. Some of these new criminal laws may change the outcome of your case. It's important for you to be aware of these changes in legislation so you can be aware of your rights if you are arrested in Austin or elsewhere in Texas. You can find a list of laws and other helpful information at the Texas Department of Public Safety website. Below is a summary of new criminal defense laws which have recently taken effect in Texas:

Driving Law Changes in Texas

  • HB 55: It is now illegal to use a cell phone or other wireless device in a designated school zone unless you are parked and the device is hands-free.
  • SB 328: If a minor is convicted of operating a boat or other water vehicle, their driver’s license will be suspended.
  • HB 2730: If you are caught driving while intoxicated and have a child in the car with you, the penalties have increased dramatically.
  • HB 55: It is a against the law for drivers under 18 years old to use a cell phone or other wireless communication device while driving.
  • HB 2012: If you drive with a suspended license and without insurance, you are subject to a Class B misdemeanor. In the event of an accident where someone gets hurt and you are driving without insurance and have a suspended or expired license, you are subject to a Class A misdemeanor.
  • HB 1813: Tampering with evidence or forensic, medical, and other reports is a criminal defense resulting in a third degree felony.
  • HB 358: Allows law enforcement to save only the computer chip from gambling machines, and not the machines themselves.

New Sex Crime Law in Texas

  • SB 689: Places a restriction on a registered sex offender's use of the internet.

Traffic Violation Changes in Texas

  • HB 2730: Increases the parking violation fines at the state level from $10 to $25, and increases the late fee from $2 to $5.
